Background

Dan Natirboff, Esquire grew up in a Foreign Service family and travelled the world extensively. He has lived in France, Sudan, Kenya, Egypt, Taiwan and the Soviet Union. During his stay in Taiwan, he taught English in Taipei.

After earning his law degree at Widener University School of Law in Harrisburg, Pennsylvania, Dan started his career being employed as an Attorney Hearing Officer, conducting formal hearings, and drafting adjudications in the area of Medical Assistance at the Department of Public Welfare’s Bureau of Hearings and Appeals. He also gained experience working with the PA Liquor Control Board and the United States Department of State at the American Embassy in Moscow.

In 1997 he joined Capozzi & Associates, which later grew to become Capozzi Adler P.C. and to this day still works there as a Partner and Chair of Reimbursement Practice Group and Licensure, Compliance, Regulatory Practice & Enforcement Group.

Positions and Accomplishments

Dan Natirboff is admitted to practice before Pennsylvania State Courts, the United States District Court for the Middle and Western Districts of Pennsylvania, and the Third Circuit Court of Appeals. He is a member of the Cumberland County Bar Association, and the Pennsylvania Bar Association and has served on the Pennsylvania Bar Association Health Law Committee, the PA Association of Home Health Agency’s Finance Committee, the PHCA Government Funding Relations Committee, the Payment for Services Committee, and, most recently, the Legal Advisory Committee. Mr. Natirboff is also the Chairman of the Cannabis Practice Group and is a member of the Pennsylvania Bar Association Medical Marijuana and Hemp Law Committee.  

In 2002, Mr. Natirboff Successfully represented Capozzi Adler’s clients in drafting an Amicus Brief and arguing before the Commonwealth Court of Pennsylvania in Millcreek Manor v. Department of Public Welfare, 796 A.2d 1020 (2002). This resulted in the Court vacating an Administrative Law Judge’s opinion denying Medicaid certification of additional licensed nursing home beds and remanding the case for a full de novo review on the merits.

In 2013, Dan Natirboff successfully argued Christ the King Manor v. Secretary, Department of Health and Human Services, 730 F.3d 291 in the Third Circuit Court of Appeals, where a DHS State Plan amendment imposing the Budget Adjustment Factor on nursing facility providers was declared invalid.

As a Partner of Capozzi Adler P.C., Dan specializes in Reimbursement and Regulatory Litigation, specifically MA Reimbursement Appeals. He has successfully litigated thousands of these reimbursement and regulatory/administrative appeals and obtained tens of millions of Dollars in Medicaid payments for the firm’s clients. He also has successfully assisted clients in the areas of Medicaid Managed Care Contracting in credentialing and contracting many Provider contracts both for Skilled Nursing Facilities and Home Health and Home Care Agencies.

Having authored articles on legal issues relevant to nursing home providers, he has been published in Nursing Home Trade Association publications nationally, including LeadingAge PA‘s legal briefs.  With his expertise in long-term care issues, Dan Natirboff frequently speaks at seminars focused on educating on such topics.

Education

Dan Natirboff, Esq. is a graduate of the University of Michigan with a Bachelor of Arts degree in Political Science. He earned his law degree at Widener University School of Law in Harrisburg, Pennsylvania.
